These terms govern your use of moseskempthorne.com and any coaching or retreat services offered through it. The services are provided by Four Elements Development LLC, a Texas limited liability company, operating under the personal brand of Moses Kempthorne. By using this site or engaging our services, you agree to these terms.
Coaching is a professional relationship focused on personal and professional development. It is not therapy, counseling, psychotherapy, or any form of mental health treatment. Moses Kempthorne is not a licensed therapist or medical professional. Nothing on this site constitutes medical, psychological, or clinical advice.
If you are experiencing a mental health crisis or require clinical support, please seek qualified professional help. Coaching is not a substitute for that.
Submitting an application through this site does not constitute an agreement to provide services. All engagements begin with a discovery call and are confirmed only through a separate written agreement between you and Four Elements Development LLC.
Payment terms, cancellation policy, and refund conditions are set out in the individual service agreement you receive before any engagement begins. Nothing on this website constitutes a binding financial commitment.
Coaching fees are non-refundable once an engagement has begun. If you are on a payment plan, payments continue for the duration of the agreed term regardless of early termination.
Retreat participation is subject to separate terms provided at the time of booking. Retreat deposits are non-refundable. For cancellations received more than 60 days prior to the retreat start date, we may offer a credit toward a future event. Cancellations within 60 days of the start date forfeit the full amount paid.
Retreat spaces are confirmed only upon receipt of a deposit.
All events are subject to force majeure, including but not limited to acts of God, natural disaster, civil disorder, governmental regulation, recognized health threats, or any other circumstance beyond our reasonable control that makes it impossible or inadvisable to hold the event. In such cases, we will offer a full credit transferable to the next available event within 12 months. No cash refunds will be issued for force majeure cancellations.
You must be at least 18 years of age to use this site or engage our services.
This site and its content are provided on an "as is" basis without warranties of any kind, express or implied. We make no warranty that this site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the site is solely at your own risk.
To the fullest extent permitted by law, Four Elements Development LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site, your participation in any service, or the acts or omissions of any third party. Our total liability in any matter is limited to the amount you paid for the specific service giving rise to the claim.
You agree to indemnify and hold harmless Four Elements Development LLC, its officers, employees, and agents from any claim, demand, or damages, including reasonable legal fees, arising from your use of this site, your violation of these terms, or your infringement of any third party's rights.
All content on this site, including text, photographs, and design, belongs to Four Elements Development LLC or is used with permission. You may not reproduce or redistribute any content without written consent.
If any provision of these terms is found to be unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
These terms, together with any separate service agreement you have entered into with us, constitute the entire agreement between you and Four Elements Development LLC with respect to your use of this site and our services.
These terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved in the courts of Texas.
